Effective date: 5 July 2026 Company: BerryMill LLC, 1712 Pioneer Ave, Ste 500, Cheyenne, WY 82001, USA ("Company", "we", "us", "our") Service: the Coreberry mobile application, the website https://coreberryapp.com, and all related features and content.

These Terms & Conditions ("Terms") are a binding agreement between you ("you", "user") and the Company. By creating an account, downloading, or using the Service, you agree to these Terms, the Privacy Policy, the AI Disclaimer, and the Disclaimers & Limitation of Liability, which are incorporated by reference. If you do not agree, do not use the Service.


1. Eligibility

1.1. You must be at least 13 years old and able to form a binding contract. If you are a minor in your jurisdiction, you may use the Service only with the involvement of a parent or legal guardian who accepts these Terms.

1.2. You represent that the information you provide is accurate and that you are not barred from using the Service under any applicable law.

2. The Service — what it is and is not

2.1. Coreberry is an informational and organizational tool to help you scan food and cosmetic products, track your allergens, log reactions, keep a food diary, and get general, non-professional information — including AI-generated content.

2.2. The Service is NOT a medical device or a medical/allergy service and does not provide professional advice. It is not a safety guarantee. See DISCLAIMERS_AND_LIABILITY.md and AI_DISCLAIMER.md. You are solely responsible for reading actual product labels and for all decisions about what you eat or use — especially if you have a food or cosmetic allergy.

3. Accounts

3.1. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3.2. Notify us immediately at legal@berrymill.app of any unauthorized use. We are not liable for losses caused by unauthorized use of your account.

3.3. We may suspend or terminate accounts that violate these Terms or the law (including automated abuse detection).

4. Subscriptions, purchases and billing

4.1. The Service offers paid subscriptions and may offer other purchases. Prices, features and tiers are shown in the app and may change with notice.

4.2. Purchases are processed by the app stores (Apple App Store, Google Play) and/or our payment partner (RevenueCat). Your purchase is also subject to the store's terms. We do not store your full payment-card details.

4.3. Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless cancelled at least 24 hours before the end of the current period, through your app-store account settings.

4.4. Cancellation & refunds. You can cancel anytime through your app-store account; cancellation takes effect at the end of the current billing period. Refunds are governed by the applicable app store's policy and by mandatory consumer-protection law in your jurisdiction. Except where required by law, fees are non-refundable.

4.5. Free trials, if offered, convert to a paid subscription unless cancelled before the trial ends.

5. Licence and acceptable use

5.1. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use, subject to these Terms.

5.2. You agree not to: (a) use the Service for any unlawful purpose; (b) reverse-engineer, decompile, or attempt to extract source code, except as permitted by law; (c) copy, resell, or commercially exploit the Service or its content; (d) upload malware or interfere with the Service's operation or security; (e) scrape or harvest data, or abuse scan limits/quotas; (f) misrepresent your identity or infringe others' rights; (g) submit content you do not have the right to submit; or (h) rely on the Service in place of professional medical care or reading the actual product label.

6. User content

6.1. You retain ownership of content you submit (allergen profiles, photos, diary entries, notes). You grant the Company a worldwide, non-exclusive, royalty-free licence to host, store, process, and display that content solely to operate and improve the Service (including sending it to third-party processors such as AI and hosting providers as described in the Privacy Policy).

6.2. You are solely responsible for your content and represent that you have the rights to submit it.

6.3. We may remove content that violates these Terms or the law.

7. Intellectual property

7.1. The Service, its software, design, trademarks ("Coreberry"), and content (excluding user content and third-party content) are owned by the Company or its licensors and protected by law. Public open datasets we use (e.g. Open Food Facts / Open Beauty Facts) remain under their own licences. No rights are granted except as expressly stated.

8. Third-party services

8.1. The Service relies on and links to third parties (app stores, cloud/hosting, AI, analytics, payment, notification providers, and public data sources). Their terms and privacy practices apply to their parts. We are not responsible for third-party services or content.

9. Disclaimers, limitation of liability & indemnity

9.1. The disclaimers, "as is"/"as available" terms, no-warranty terms, limitation of liability (including the liability cap), assumption of risk, and indemnification set out in DISCLAIMERS_AND_LIABILITY.md are incorporated into and form part of these Terms. They are a fundamental basis of this agreement. The Company disclaims responsibility to the maximum extent permitted by law for any harm to any person arising from use of, or reliance on, the Service — including any allergic reaction.

10. Changes to the Service and Terms

10.1. We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms; material changes will be notified in-app or by email, and continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service.

11. Termination

11.1. You may stop using the Service and delete your account at any time. We may suspend or terminate your access for any breach of these Terms or where required by law. Sections that by their nature should survive (including IP, disclaimers, limitation of liability, indemnity, and governing law) survive termination.

12. Governing law and disputes

12.1. These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws rules.

12.2. [Choose one and have a lawyer confirm:] Disputes shall be resolved (a) by the competent courts of the State of Wyoming, USA; or (b) by binding individual arbitration, with a waiver of class actions, except where prohibited by law. Mandatory consumer-protection rights in your country of residence are not affected.

13. Miscellaneous

13.1. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. These Terms, with the incorporated documents, are the entire agreement between you and the Company regarding the Service.

14. Apple / Google specific

14.1. If you downloaded the app from the Apple App Store, the Apple standard EULA and Apple's "Licensed Application" terms also apply; Apple is a third-party beneficiary and may enforce these Terms, but Apple is not responsible for the app or any claims relating to it. Similar provisions apply to Google Play.

AI Features Disclaimer — Coreberry

1. What uses AI

Coreberry uses artificial intelligence, including large-language and computer-vision models provided by third parties (currently Google Gemini as the primary provider and OpenAI as a fallback), to power features such as:

The allergen match itself and the health-score formula are computed deterministically from curated reference data (our allergen catalog, Open Food Facts / Open Beauty Facts, the EU allergen lists) — but the ingredient text on a photo scan is read by AI and may be wrong (see §2). Barcode scans use structured product-database data rather than an AI guess.

2. AI can be wrong

2.1. AI output is generated automatically and is probabilistic. It can be inaccurate, incomplete, outdated, biased, or entirely incorrect. On a photo scan it may:

3. No reliance — verify everything, every time

3.1. Coreberry is an aid, not a safety guarantee. If you have a food or cosmetic allergy — especially a severe or anaphylactic allergy — never decide that a product is safe based on Coreberry alone.

3.2. Always: (a) read the actual product packaging and full ingredient list yourself; (b) when in doubt, do not consume or use the product; and (c) for any medical question consult a licensed doctor or allergist.

3.3. A green / "no allergens detected for you" result means only that our automated check did not find a match in the text it read — it is not a guarantee that the product is safe. A photo scan can miss an ingredient the AI did not read.

3.4. See DISCLAIMERS_AND_LIABILITY.md — the Company accepts no liability for any harm arising from AI output, and you use AI features at your own risk.

4. Your inputs

4.1. To provide AI features, your inputs — photos of food labels, products, dishes or cosmetics, and any text you submit — may be sent to and processed by third-party AI providers (Google Gemini, OpenAI) to generate results. See PRIVACY_POLICY.md for how this data is handled. Do not submit content you are not comfortable sharing with those providers.

4.2. You are responsible for ensuring you have the right to submit any content (including photos) you upload.

5. No guarantee of availability or consistency

5.1. AI features may change, degrade, be limited, or be withdrawn at any time. Identical inputs may produce different outputs. We do not guarantee that AI features will be available, accurate, or consistent.

Disclaimers & Limitation of Liability — Coreberry

By accessing or using the Service, you acknowledge that you have read, understood and agree to the disclaimers below. If you do not agree, do not use the Service.


1. Not medical advice — not a safety device

1.1. Coreberry is an informational and organizational tool. It is not a medical device, not a medical or allergy service, and does not provide medical, dietary, diagnostic, or treatment advice.

1.2. No content in the Service — including ingredient extraction, allergen indications, nutrition estimates, health scores, tips, or any output generated by artificial intelligence — is a substitute for the professional judgment of a licensed doctor, allergist, or dietitian, or for reading the actual product packaging yourself.

1.3. Always consult a qualified healthcare professional for any question about your allergies, diet, or health. Never disregard professional advice, or delay seeking it, because of anything you read or receive in the Service.

1.4. Emergencies / allergic reactions. If you are experiencing an allergic reaction or a medical emergency, stop, use your emergency medication (e.g. an adrenaline auto-injector) if prescribed, and contact emergency services immediately. The Service is not designed for, and must not be used in, emergencies.

2. AI-generated content

2.1. Parts of the Service use artificial intelligence (third-party AI models from Google and OpenAI) to read food and cosmetic labels, extract ingredients, recognize dishes, and generate text. See AI_DISCLAIMER.md.

2.2. AI output can be inaccurate, incomplete, outdated, or wrong. It may "hallucinate" ingredients, misread a label, or miss an ingredient or allergen entirely. You must independently verify any result against the actual product packaging — and, for medical decisions, with a healthcare professional — before acting on it.

2.3. You use AI features entirely at your own risk. The Company does not warrant the accuracy, reliability, safety, or fitness for any purpose of any AI output.

3. Food, ingredient and allergen information — the core warning

3.1. Food, cosmetic, ingredient, nutrition and allergen information may be incomplete, out of date, or incorrect, and product formulations change without notice. Manufacturers, not the Company, are responsible for their product labels and formulations.

3.2. A "safe" or "no allergens detected" indication is NEVER a guarantee that a product is safe for you. It means only that our automated check did not find a match in the information available to it — a photo scan can miss an ingredient it did not read, a database can be out of date, and a formulation can change.

3.3. If you have a food or cosmetic allergy — especially a severe, life-threatening, or anaphylactic allergy — do NOT rely on Coreberry to keep you safe. Always read the full ingredient list on the actual packaging yourself, and when in doubt, do not consume or use the product.

3.4. Menu and dish information obtained through venue/restaurant detection is provided by third parties (e.g. the venue, delivery platforms) and may be inaccurate or out of date; the same warnings apply.

4. "As is" and "as available" — no warranties

4.1. The Service is provided "AS IS" and "AS AVAILABLE", with all faults and without warranties of any kind.

4.2. To the maximum extent permitted by law, the Company disclaims all warranties, express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.

4.3. The Company does not warrant that the Service will be uninterrupted, timely, secure, error-free, or free of harmful components, or that any defects will be corrected, or that results obtained will be accurate or reliable.

5. Limitation of liability

5.1. To the maximum extent permitted by applicable law, the Company (and its officers, directors, employees, contractors, agents, suppliers, and licensors) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, goodwill, data, or other intangible losses — arising out of or relating to your access to, use of, or inability to use the Service, under any legal theory, and whether or not the Company was advised of the possibility of such damages.

5.2. Without limiting the above, the Company shall not be liable for any harm, injury, illness, allergic reaction, death, expense, or loss suffered by any person arising from or related to: (a) reliance on any content or AI output in the Service; (b) any action taken or not taken based on the Service; (c) any food, product, ingredient, or consumption decision; (d) errors, inaccuracies, or omissions in any content, label reading, or allergen match; or (e) any interruption, unavailability, or failure of the Service.

5.3. Aggregate cap. To the maximum extent permitted by law, the Company's total aggregate liability for all claims relating to the Service shall not exceed the greater of (a) the amount you paid the Company in the twelve (12) months preceding the event, or (b) USD 50 (fifty US dollars).

5.4. Basis of the bargain. You acknowledge that these disclaimers and limitations are a fundamental basis of the agreement, that the Company would not provide the Service without them, and that they apply even if any limited remedy fails of its essential purpose.

5.5. Jurisdictional limits. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities (for example, for death or personal injury caused by negligence, fraud, or certain consumer rights). In those jurisdictions, the Company's liability is limited to the smallest amount permitted by law, and nothing in this document excludes liability that cannot lawfully be excluded.

6. Your responsibility & assumption of risk

6.1. You are solely responsible for your own health and safety and for every decision you make about what you eat or use.

6.2. You assume all risk arising from your use of the Service and from any reliance on its content or AI output.

6.3. You are responsible for reading actual product packaging, verifying information with a healthcare professional where appropriate, and using your own judgment.

7. Indemnification

7.1. You agree to defend, indemnify and hold harmless the Company and its officers, directors, employees, contractors, agents, suppliers and licensors from any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or connected with: (a) your use of or reliance on the Service; (b) your violation of these disclaimers or the Terms; (c) your violation of any law or the rights of any third party; or (d) any harm to any person resulting from your decisions or actions.

8. Third-party content and links

8.1. The Service may reference or link to third-party products, websites, venues, menus, or content. The Company does not endorse and is not responsible for any third-party content, products, or services, and is not liable for any loss arising from your use of them.

9. Governing law

9.1. These disclaimers are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws rules, and are subject to the dispute-resolution and governing-law terms in TERMS_AND_CONDITIONS.md.

We keep cookies to a minimum. Our website analytics use Umami, a self-hosted, privacy-friendly analytics tool that does not use cookies and does not track you across sites or build an advertising profile. We do not use advertising or cross-site tracking cookies, and we do not sell your personal data.
